1. Acceptance of these terms
By accessing or using SWOTBuilder, you agree to be bound by these Terms & Conditions.
If you do not agree, you should not use the platform.
If you use SWOTBuilder on behalf of a company, organisation or client, you confirm that you have
the authority to accept these terms on behalf of that entity.
2. The service
SWOTBuilder is a digital platform for creating and managing SWOT analyses, collaborative strategy boards,
TOWS matrices, related exports, and selected AI-supported features.
The service may include free and paid functionality, guest collaboration, document analysis,
and product features that are still evolving as part of ongoing development.
3. Accounts and access
Some features require a registered account. You are responsible for keeping your login credentials secure
and for all activity that happens under your account.
You must provide accurate information when creating an account and keep it reasonably up to date.
We may suspend or restrict access if we reasonably believe an account is being misused or used in breach
of these terms.
Guest access
Some boards may be shared with guests through collaboration links. Guest access is controlled by the board owner
or workspace administrator and may be view-only or editable depending on the settings chosen.
4. Plans, billing and cancellation
SWOTBuilder may offer both free and paid plans. Features, usage limits and pricing may differ per plan.
If you purchase a paid subscription, you agree to the applicable pricing, billing cycle and payment terms
presented at checkout.
- Paid subscriptions may renew automatically unless cancelled before the next billing date.
- If payment fails, access to paid features may be suspended, downgraded or limited.
- You may cancel according to the subscription management options made available to you.
- Unless explicitly stated otherwise, fees already paid are non-refundable.
5. User content
You retain ownership of the content you create, upload or submit to SWOTBuilder, including SWOT items,
tags, documents, strategy texts and related material.
By using the service, you grant SWOTBuilder a limited, non-exclusive right to host, process, store,
transmit and display your content as necessary to operate, secure and improve the service.
You are responsible for ensuring that you have the necessary rights to upload or use any content you submit.
6. Acceptable use
You agree not to use SWOTBuilder in any way that is unlawful, harmful, abusive or disruptive.
- Use the service to violate applicable law or third-party rights.
- Upload malware, harmful code, or content intended to disrupt systems.
- Attempt to gain unauthorised access to accounts, data or infrastructure.
- Scrape, copy or reverse engineer the platform beyond what is allowed by law.
- Use the service to transmit illegal, infringing or clearly abusive content.
We may remove content or restrict access where reasonably necessary to protect the service, users,
or third parties.
7. Availability, maintenance and product changes
We aim to keep SWOTBuilder available and useful, but we do not guarantee uninterrupted availability,
error-free operation or permanent availability of every feature.
We may perform maintenance, release updates, improve workflows, change interfaces, or discontinue features
as the product evolves. Where reasonably possible, we try to make such changes in a responsible way.
8. Intellectual property
SWOTBuilder and its underlying software, visual design, branding, structure and platform elements remain
the property of SWOTBuilder or its licensors, except for user content owned by users.
These terms do not transfer ownership of the platform itself. They grant you a limited right to use the service
in accordance with your plan and these terms.
9. Disclaimer and limitation of liability
SWOTBuilder is provided on an “as is” and “as available” basis, to the maximum extent permitted by law.
We do not guarantee that the service will always be uninterrupted, fully secure, or suitable for every use case.
To the extent permitted by applicable law, SWOTBuilder will not be liable for indirect, incidental,
consequential, special or punitive damages, or for loss of profits, business, goodwill, data or opportunity.
To the extent permitted by law, our total liability arising out of or relating to the service will not exceed
the amount you paid to SWOTBuilder during the twelve months before the event giving rise to the claim,
or, if you used only the free plan, a reasonable nominal amount.
10. Suspension and termination
You may stop using SWOTBuilder at any time. We may suspend or terminate access where reasonably necessary,
including in cases of misuse, non-payment, legal obligation, security risk, or material breach of these terms.
Upon termination, your right to use the service ends, but provisions that reasonably should survive termination
will continue to apply, including provisions relating to ownership, liability and governing law.
11. Governing law
These Terms & Conditions are governed by and interpreted in accordance with the laws applicable to the operator
of SWOTBuilder, unless mandatory consumer law requires otherwise.
Any disputes will be submitted to the competent courts of the relevant jurisdiction, unless applicable law
provides otherwise.
